1 GENERAL SALES CONDITIONS
1.1 The general conditions of sale published therein govern the sales contract (hereinafter, for brevity, the "Agreement") to users of the Site (hereinafter, for brevity, the "Buyers" or the "Buyer"), through electronic means , of the goods (hereinafter, for brevity, the "Property" or "Goods") displayed on the Internet Site www.ancote.com (hereinafter, for brevity, the "Site"), managed by ANCOTE S.R.L. - based in Como , Via Don Brusadelli 41 – 22100 Como, VAT number: 01208250181 (hereinafter, for the sake of brevity, "ANCOTE").

1.2 The General Conditions of Sale published on the Site must be viewed and known by the Purchaser before making the purchase of a Good and by sending the purchase order, the Purchaser declares to have viewed and accepted them.
The Buyers will also benefit from the protections provided in the event of the conclusion of distance contracts pursuant to Title III, Section II, of Legislative Decree 6 September 2005, no. 206 ("Consumer Code"), as well as all the additional mandatory protections provided, in favor of Buyers, by the Consumer Code itself https://www.codicedelconsumo.it/

1.3 The "Shipping", "Exchanges and Returns", "Payments" sections on the Site must be considered an integral and substantial part of these General Conditions of Sale. 

2 CONCLUSION OF THE CONTRACT
2.1 To proceed with the purchase of the Goods, the Purchaser must send his purchase order and make the payment, following the procedures indicated in the specifically dedicated sections.

2.2 In particular, the steps to proceed with the purchase are as follows:

  • The Purchaser will be able to freely access the Site and view the essential characteristics of the Goods displayed, including the price, as well as the images published for the purpose of illustrating the Goods themselves;
  • The Purchaser may select one or more Goods which he intends to purchase, placing them in a virtual "cart". The contents of the cart can always be viewed by the Purchaser before proceeding with the forwarding of the order; furthermore, by accessing the cart, the Purchaser will be able to know, before the purchase and payment, all information relating to the purchase of the Goods, including shipping costs and expected delivery times;
  • To make the purchase, the Purchaser must register on the Site, communicating his email address and a password of his choice, which will allow him to access the Site itself;
  • As an alternative to registering on the Site, the Purchaser can make the purchase as a guest. In this case, the data requested in order to complete the order will be stored in the ANCOTE database only for the period of time necessary to process the order and the Purchaser will be required to enter the same data for each new order;
  • In order to complete the order, the Purchaser, in the "cart" section, must also enter the shipping address and the data required for payment;
  • the Purchaser will be able to modify the Goods chosen and the data entered until the definitive forwarding of the order, which must take place by selecting the "Payment" button.

2.3 The Purchaser can make the payment by credit card or paypal. Further information on the payment methods is available in the "Payments" section of the Website.

2.4 Once the purchase order has been received, ANCOTE will send an order confirmation receipt containing a summary of the information relating to the purchase to the Buyer's email address and will proceed with the order itself. In any case, the order will be considered accepted and, consequently, the Contract will be considered concluded when the Purchaser receives the order confirmation on his e-mail account.

2.5 The contract will be archived in pdf format and will be sent via the aforementioned email and archived electronically to ANCOTE.

3 RIGHTS AND OBLIGATIONS OF THE PARTIES
3.1 ANCOTE will deliver the Goods to the address communicated by the Purchaser in the purchase order, via a specially appointed carrier. More detailed information on times, costs and places of shipment are available in the "Shipping" section of the Site.

3.2 ANCOTE assumes no responsibility for any errors in the delivery due to inaccuracies or incompleteness in completing the purchase order by the Purchaser or for any damage that may occur to the Goods after delivery to the carrier as well as for any delays in delivery depending on the carrier itself or on weather conditions, international customs issues or other circumstances beyond the control of ANCOTE.

3.3 In the event that one or more Goods are not available, ANCOTE will notify the Customer by sending an email to the email address indicated by the same when registering on the Site. In this case, ANCOTE will refund the Customer, by crediting the payment card or the Buyer's account indicated for the purchase, the price and, if the purchase concerned only the unavailable Good, the shipping costs.

3.4 In any case, the unavailability of one or more ordered Goods cannot constitute grounds for cancellation of the entire order by the Purchaser.

3.5 Upon delivery of the Goods by the carrier in charge of the relative transport, the Purchaser must verify in the presence of the carrier:

  • that the packaging used for transport is intact, not damaged or altered, even only in the sealing materials;
  • ​that the quantity and type of Goods ordered correspond to what is indicated in the transport document and what was ordered.

3.6 If the Purchaser finds any anomalies or discrepancies, he must immediately notify the carrier upon delivery of the Goods.

3.7 The Purchaser is solely responsible for the truthfulness and correctness of the information and data provided to ANCOTE and undertakes to promptly communicate any changes to the data previously communicated.

4 CONFORMITY OF THE GOODS
4.1 ANCOTE undertakes to ensure that the description and/or photographic representation of the Goods on the Site is as faithful as possible to the Goods themselves. However, taking into account the fact that the quality of the images may depend on the IT tools used by the Purchaser, it is possible that the Purchaser's perception of the description or photographic representation of the Goods does not correspond exactly to the Good itself, so that the images and the videos accompanying the presentation of the Goods must be considered published on the Site for a purely descriptive purpose.

4.2 In the event that the delivered Good is ascertained as defective or different from the one ordered, ANCOTE undertakes to provide the Customer with a legal guarantee of conformity, to be exercised under the conditions and within the terms set forth in articles 128 et seq. of Legislative Decree No. 206/2005. In particular, the Purchaser will have the right to request, alternatively:

  • the delivery of a Good identical to the one ordered compatibly with stock availability, or
  • the delivery of a Good of quality and equivalent price compatibly with stock availability, or
  • the reimbursement of the price of the Good and of the shipping costs.

4.3 The warranty provided for in this article will only apply if the Goods have been handled with due diligence and in compliance with their intended use, as well as upon presentation by the Purchaser of the delivery note received and indication of the number of order.

4.4 In any case, the guarantee referred to in this article will not apply with reference to defects deriving from normal wear and tear of the Goods.

5 WITHDRAWAL
5.1 In compliance with the provisions of the Consumer Code, the Purchaser has the right to withdraw from the Contract, without paying penalties and without having to specify the reasons, starting from the receipt of the order confirmation sent by ANCOTE and within the term of fourteen working days from receipt of the Good.

5.2 If the Purchaser intends to make use of this right of withdrawal, he must provide, within the aforementioned term of 14 working days from the date of delivery of the Goods, to send ANCOTE a specific communication.

5.3 In the event of exercising the right of withdrawal, the Purchaser will also be required to return the Goods to ANCOTE within and no later than two weeks from the sending of the aforementioned communication.

5.4 Further information on the procedure and instructions to follow for exercising the right of withdrawal and related expenses are available in the "Exchanges and Returns" section of the Website.

5.5 An essential condition for exercising the right of withdrawal will be the substantial integrity of the product to be returned. In any case, it is sufficient that the Goods be returned in a normal state of conservation, as they have been kept and possibly handled with the use of normal diligence.

5.6 In particular, the Goods must be returned:

  • correctly packed in their original packaging, in perfect condition for resale (not ruined, damaged or soiled) and equipped with all possible accessories and documentation;
  • equipped with the transport document (present in the original packaging), in order to allow ANCOTE to identify the Purchaser (Order number, name, surname and address);
  • without manifest signs of use, if not those compatible with carrying out a normal test of the article. That is, they must not bear traces of prolonged use (over a few minutes) exceeding the time necessary for a test and must not be in such a state as to not allow their resale.

5.7 The costs of returning the Goods will be borne by the Purchaser, as better specified in the "Exchanges and Returns" section of the Website.

5.8 Following the exercise by the Purchaser of the right of withdrawal in accordance with these General Conditions of Sale, ANCOTE will reimburse the Customer for the sums paid by the same, by crediting the payment card or current account indicated for the purchase. The refund will be made within 14 days from the date on which ANCOTE became aware of the exercise of the right of withdrawal by the Purchaser.

5.9 In the event of failure by the Purchaser to comply with the conditions pursuant to art. 5.5 and 5.6, the Seller reserves the right to deduct from the reimbursement of the sums paid by the Purchaser an amount corresponding to the decrease in value of the returned Goods, giving specific notice to the Purchaser. Following this communication, the Purchaser still has the possibility of getting back, at his own expense, the products in the state in which they were returned to the Seller.

5.10 The right of withdrawal, in any case, cannot be applied with reference to the following Goods:

  • personalized goods or goods which, by their nature, cannot be returned or are liable to deteriorate or expire rapidly;
  • underwear and beachwear

6 PROTECTION OF PERSONAL DATA
6.1 Personal data collected during registration and/or purchase, as well as any navigation data will be processed by ANCOTE S.R.L. as data controller in compliance with current legislation on the protection of personal data (Regulation (EU) 2016/679. For more information on the processing of personal data, please consult the Privacy Policy which can be reached via the appropriate links at the bottom to the forms on the site.

7 MISCELLANEOUS
7.1 ANCOTE reserves the right to modify these General Conditions of Sale at any time.

7.2 The General Conditions of Sale applicable to the sale of each Good will be those published on the Site on the date of the order relating to the Good itself. The Purchaser, therefore, must view and accept these General Conditions of Sale before proceeding with any purchase.

7.3 If any provision of these General Conditions of Sale should be considered void or invalid, these General Conditions of Sale will in any case remain valid and effective in the remaining part.

7.4 The mere tolerance or failure to dispute by ANCOTE of any breaches by the Purchaser with respect to what is contained in the General Conditions of Sale cannot be interpreted as tacit acceptance of such breaches, nor as a desire to derogate from what was agreed between the parties.

8 COMMUNICATIONS
For any communication and/or request for assistance and/or complaint relating to the Goods purchased, the Buyer may contact ANCOTE at the addresses indicated in the "Contact" section of the Website.

9 APPLICABLE LAW AND DISPUTE RESOLUTION
These General Terms and Conditions of Sale are governed by Italian law and, therefore, will be interpreted and performed in accordance with it.

10 PRE ORDER ACCEPTANCE SUMMARY WINDOW
10.1 The products purchased on this site are sold directly by ANCOTE S.R.L. - with registered office in Como, Via Don Brusadelli 41 – 22100 Como, VAT number: 01208250181 (hereinafter, for the sake of brevity, "ANCOTE"). You will be able to find information regarding orders and shipments, refunds and the return of products purchased on this site also in the "Shipping and Delivery" and "Return and Exchange" sections of the Site. Remember that, even after your purchase, you can always contact ANCOTE through the following "Contacts".

10.2 You have the right to withdraw from the contract concluded with ANCOTE, without any penalty and without specifying the reason, within fourteen (14) days, starting from the day of receipt of the products purchased on this site. To withdraw from the contract, you must complete the Return Form found in the "Exchanges and Returns" section of the site and send an email to [email protected] to request an authorization number. The request must contain the order number, the code of the item to be returned and the reason for the return: refund, size or color change. Once the written request has been received [email protected] will send a written confirmation with an authorization number. You must write this authorization number on the return form attached to each item and on the outside of the box.

10.3 The Right of Withdrawal is understood to be exercised correctly if the following conditions are also fully respected: a. The Return Form and security seal must still be intact and attached to the returned items. They must not be removed or cut in any way. b. Items must not have been worn, washed or altered in any way and must not show any signs of use. The soles of the footwear must be in perfect condition and must not be marked in any way. c. Items must be returned with all original tags, packaging and other accessories (bags, hangers, garment bag, etc.) received with the order.; And. returned products must be delivered to the shipper within fourteen (14) days from when you communicated your decision to withdraw from the contract to ANCOTE.

10.4 The shipping costs for returning items are charged to the Customer. Any customs duties are always charged to the customer. All information regarding withdrawals are available in the Legal Area - "Terms and Conditions" and in the "Exchanges and Returns" section of the Website.

11 TERMS OF USE OF THE SITE COMMERCIAL POLICY
11.1 The website www.ancote.com is managed by ANCOTE S.R.L. - with registered office in Como, Via Don Brusadelli 41 - 22100 Como, VAT number: 01208250181 (hereinafter, for the sake of brevity, "ANCOTE").

11.2 Access to and navigation on the website www.ancote.com are governed by these Terms of Use of the Website, so that by accessing and browsing the website www.ancote.com, users undertake to agree to comply with these Terms.

11.3 Access to the Site and related services is intended exclusively for personal use unrelated to any commercial, entrepreneurial or professional activity.

12 INTELLECTUAL AND INDUSTRIAL PROPERTY
12.1 The Site and its contents (by way of example but not limited to: works, images, photographs, dialogues, music, sounds and videos, documents, drawings, figures, menus, web pages , graphics, colors, schemes, tools, characters and design of the website), as well as the trademarks and distinctive signs used by ANCOTE in relation to the sale of goods, are protected by the rules on intellectual property rights and industrial. Consequently, any type of reproduction, communication, distribution, publication, alteration or transformation, in any form and for any purpose, of the contents of the Site, of the brands and distinctive signs used by ANCOTE is prohibited unless expressly authorized by the holders of rights .

12.2 The trademarks and distinctive signs present on the Site that distinguish the products sold on www.ancote.com are the property of their respective owners and are used within the Site for the sole purpose of distinguishing, describing and advertising the goods on sale.

13 USE OF THE SITE
13.1 The user is solely responsible for the use of the Site and its contents, as well as solely responsible for the custody and correct use of their personal information, including the credentials that allow access to the Site and for any harmful or prejudice that may derive from the incorrect use, loss, theft of such information.

13.2 Except for liability for willful misconduct and gross negligence, ANCOTE assumes no responsibility for the use of the Site and the contents by the User that does not comply with the laws in force, nor for the communication of incorrect, false or incorrect information and data relating to third parties, without these having given their consent.

13.3 ANCOTE assumes no responsibility for malfunctions of the Site or for damages caused to the User by the use of the Site, which are not causally attributable to ANCOTE itself.

13.4 ANCOTE publishes information on its website in order to provide a service to users, but declines all responsibility for any technical inaccuracies and/or typographical errors. If reported, ANCOTE will make the corrections immediately.

However, ANCOTE declines all responsibility for any problems, damages, viruses or risks that the user may incur during the improper use of the website and declines all responsibility for any malfunctioning of the website due to the deactivation of "cookies" in the user's browser.

14 COMMERCIAL POLICY
14.1 The offer and sale of products on the website www.ancote.com are governed by the conditions set out in the paragraph General Conditions of Sale. ANCOTE offers its products for sale and carries out its e-commerce activity exclusively towards end users who are "consumers".

14.2 "Consumer" means any natural person who works on www.ancote.com for purposes unrelated to any entrepreneurial, commercial, craft or professional activity carried out. In consideration of its commercial policy, ANCOTE reserves the right not to process orders from subjects other than the "consumer" or in any case to orders that do not comply with its commercial policy.

14.3 In particular, to place orders on the site, Customers must: - be consumers - be over 18 years old - have the necessary requirements to be able to enter into legally binding contracts - Have a valid POP e-mail address - have a valid credit card: Visa, American Express, MasterCard or a paypal account.

14.4 On www.ancote.com only top quality branded products are offered for sale. The essential characteristics of the products are presented on www.ancote.com within each product sheet.

14.5 ANCOTE undertakes to ensure that the description and/or photographic representation of the products is as faithful as possible to the products themselves. 15 PROMO CODES
Customers who have received a PROMO CODE via newsletter, via social networks or on compliant promotional websites can enter the code when purchasing an order or at checkout. Each code has a validity start and end date which limits its use and cannot be extended.

16 ORDER PROCESSING
Once an order for available products has been placed, no changes can be made to that order. Orders placed separately will be shipped separately. ANCOTE reserves the right to delay a shipment if the order cannot be shipped for reasons beyond ANCOTE's control. Please note that during promotions and sales there may be delays in shipping. ANCOTE reserves the right to refuse to process an order and/or service at any time.
